Bankruptcy Exemptions — Douglasville Georgia Lawyers

Understanding Your Exemptions in Bankruptcy

If you are considering filing bankruptcy, you may wonder what property you can keep. Georgia law allows people filing Chapter 7 bankruptcy to keep their property. This property is called exempt property. Each situation is different and depends on individual circumstances. You want an experienced bankruptcy attorney to help you understand your rights and your opportunities.

Bankruptcy Exemptions

When you file a Chapter 7 bankruptcy, you are allowed to permanently discharge, or wipe out, debts and keep certain assets. The assets you may keep are determined by state law and usually include your home, a motor vehicle and retirement plans. You can protect some personal property as well. Our attorneys will carefully explain what you can keep, so that you can decide whether Chapter 7 is right for you.

Chapter 13 bankruptcy does not require the sale of your property if you can keep your payments current. In most cases, Chapter 13 will stop foreclosure on your house and repossession of your car.
