Understanding How Bankruptcy Puts a Stop to Debt Collection

If you have fallen behind on repaying a debt — such as a credit card balance, medical bill, bank loan or finance company loan — your creditor can sue you and get a judgment against you. This judgment allows the creditor to take a number of different debt collection measures.

Once a bank or other creditor has a judgment against you, it can file garnishments on your paychecks and bank accounts, taking your money until the debt is repaid in full.

A creditor with a judgment can also send the sheriff to your home to levy on (take) your personal property and may even be able to foreclose and sell your home to repay the debt.

The good news is that the moment you file bankruptcy, all lawsuits against you and garnishments of your wages and bank accounts must stop, and if the debt can be discharged (wiped out) in bankruptcy, your attorney will file motions to remove any judgment liens from your property.
